1. Acceptance of Terms
By accessing or using the Afribary Enterprise platform ("Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use the Service.
2. Description of Service
Afribary Enterprise provides institutional repository, journal management, and digital library solutions for higher institutions of learning, professional bodies, and corporate organisations.
3. Account Registration
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
4. Subscriptions and Payment
Some features of the Service require a paid subscription. By subscribing, you agree to pay the applicable fees. Subscription fees are billed in advance on a monthly or yearly basis, depending on the plan selected.
- Fees are non-refundable except as described in our Refund Policy
- We reserve the right to change subscription fees with 30 days' notice
- Failure to pay may result in suspension of your account
5. User Content
You retain ownership of all content you upload to the platform. By uploading content, you grant Afribary a non-exclusive licence to store, process, and display the content as necessary to provide the Service.
You agree not to upload content that:
- Infringes on any third party's intellectual property rights
- Contains malicious code or viruses
- Violates any applicable law or regulation
- Is defamatory, obscene, or otherwise objectionable
6. Institutional Repository Applications
Applications for institutional repositories are subject to review and approval by Afribary. We reserve the right to reject any application at our sole discretion. Approved applications are subject to the subscription plan terms agreed upon during the approval process.
7. Intellectual Property
The Service and its original content (excluding user content), features, and functionality are and will remain the exclusive property of Afribary and its licensors.
8. Termination
We may terminate or suspend your account at any time for violation of these Terms. Upon termination, your right to use the Service will immediately cease. You may request export of your data within 30 days of termination.
9. Limitation of Liability
To the maximum extent permitted by law, Afribary shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting a notice on the platform or sending an email to registered users.
